FITRA Terms of Service

These Terms of Service ("Terms") are an agreement between you (the business using FITRA, "Customer" or "you") and FITRA ("FITRA", "we", "us"). By creating an account, subscribing, or using the FITRA website, dashboard, or API (the "Service"), you agree to these Terms. If you use the Service for a company, you confirm you may bind that company.

1. The Service

FITRA is software that helps brands find Instagram creators, analyze how well they fit a campaign, draft and send outreach emails from the Customer's own email account, and track campaign results (including through a Customer-connected Shopify store). Features may change over time. AI scores, analyses, and email drafts are suggestions only; you decide whom to contact, what to send, and what deals to make.

2. Accounts

You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account. Tell us promptly at support@fitra.io if you suspect unauthorized access. You must be at least 18 and using the Service for business purposes, not as a consumer.

3. Plans, fees and billing

• Subscriptions are billed monthly in advance through our payment processor (Stripe). Prices and included monthly allowances (e.g. Casting results, Advanced Profiles, FITRA Scores, personalized emails) are shown before you subscribe.
• Unused allowances do not roll over. We may limit use that exceeds your plan.
• Fees are exclusive of taxes, which you are responsible for where applicable.
• We may change prices with at least 30 days' notice; changes apply from your next billing period.

4. Cancellation and refunds

You can cancel anytime; cancellation takes effect at the end of the current billing period and you keep access until then. Fees already paid are non-refundable except where required by law or where we decide otherwise for a billing error.

5. Your responsibilities

You agree to: - Use the Service only for lawful creator-partnership outreach and to comply with all laws that apply to you, including anti-spam laws (e.g. CAN-SPAM, CASL, GDPR/ePrivacy where relevant), advertising-disclosure rules (e.g. FTC Endorsement Guides), and privacy laws. - Include truthful sender information and honor opt-outs. FITRA adds an unsubscribe link and your mailing address to every email and blocks anyone who has opted out; you must not work around these controls. Only FITRA can lift an opt-out, and only at the creator's own written request. - Send email only from accounts you own and are authorized to use, and follow your email provider's terms and sending limits. - Not use the Service to harass, deceive, or discriminate against anyone, to send unsolicited bulk marketing unrelated to a genuine collaboration offer, or to collect data for resale. - Not scrape, reverse engineer, overload, or attempt to gain unauthorized access to the Service, or share accounts across separate businesses. You are solely responsible for your campaign decisions, offers, contracts, payments to creators, and your relationships with creators.

6. Third-party services

The Service works with third-party services such as Instagram/Meta public data, Google Gmail, Shopify, OpenAI, and Stripe. Your use of those services is governed by their terms. We are not responsible for third-party services, their availability, or changes to their APIs, which may affect features.

7. Data

• Your data (campaign briefs, notes, drafts, results, connected-store data) remains yours. You grant us a license to process it only to provide, secure, and improve the Service.
• Creator data: FITRA processes publicly available creator information as described in our Privacy Policy. You may use it only to evaluate and contact creators for genuine collaborations, and must delete or stop using it if a creator asks you to.
• Our handling of personal data is described in the Privacy Policy.
• We may use aggregated, de-identified usage data to operate and improve the Service.

8. Intellectual property

We own the Service, including software, scoring methods, designs, and the FITRA name. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. Feedback you give us may be used without obligation to you.

9. Availability and changes

We aim for reliable service but do not guarantee it will be uninterrupted or error-free. We may modify or discontinue features; for material reductions of paid features we will give reasonable notice.

10. Suspension and termination

We may suspend or terminate access if you breach these Terms, create risk or legal exposure for us or others (for example, spam complaints or abuse), or fail to pay. You may stop using the Service at any time. After termination we may delete your data after 30 days; you can ask us for an export before then.

11. Disclaimers

THE SERVICE, INCLUDING AI OUTPUT, SCORES, CREATOR DATA, AND REVENUE ATTRIBUTION, IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE ANY CAMPAIGN RESULT, REPLY RATE, OR SALES.

12. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

13. Indemnity

You will defend and indemnify us against third-party claims arising from your campaigns, your emails and communications with creators, your offers and contracts, or your breach of these Terms or applicable law.

14. General

• Governing law: California, without regard to conflict-of-law rules. Courts in Los Angeles County, California have exclusive jurisdiction.
• We may update these Terms; material changes will be notified by email or in the Service at least 15 days before they take effect. Continued use means acceptance.
• You may not assign these Terms without our consent. If a provision is unenforceable, the rest remains in effect. These Terms are the entire agreement on this subject.
